K-9 Business Owner Acquitted After Judge Grants Directed Verdict in Heat-Related Dog Deaths Case

Case Background

In July 2023, Michael McHenry, owner of FM K9, faced a devastating situation when 18 dogs being transported from O'Hare International Airport to his facility in Michigan began experiencing heat-related distress. The dogs were being transported in a box truck equipped with an IcyBreeze air conditioning unit when they went into distress at a Road Ranger gas station in Lake Station, Indiana.

The Charges

The Lake County Prosecutor's Office filed 18 misdemeanor counts of animal cruelty against McHenry following an investigation by Indiana State Police. The charges followed PETA's request for an independent investigation after Lake Station police department determined the incident did not constitute animal cruelty.

After the prosecution rested its case, the defense sought a motion for a directed verdict, a formal request for the judge to find the defendant not guilty because the prosecution failed to present sufficient evidence to convict.

Judge granted the motion, effectively ending the case and finding McHenry not guilty on all 18 counts. A directed verdict is only granted when the evidence, viewed in the light most favorable to the prosecution, is insufficient to support a conviction.

The ruling meant prosecutors had failed to prove beyond a reasonable doubt that McHenry acted recklessly or with criminal negligence under Indiana law.

Resolution and Impact

McHenry maintained throughout the proceedings that the tragedy resulted from an unforeseeable equipment failure combined with circumstances beyond his control. The surviving dogs were sold to law enforcement agencies and, according to McHenry and his legal team, "are all healthy and have great careers."

While Indiana State Police expressed disappointment in the verdict, they acknowledged respect for the judicial process and the court's authority. The case highlighted the high standard of proof required in criminal prosecutions and the distinction between tragic accidents and criminal conduct.
